A private executor is a subject of independent professional activity, authorized by the state to carry out enforcement of decisions determined by law and in the manner and procedure established by law.

  • writ of execution and orders issued by courts in cases provided for by law on the basis of court decisions, decisions of an arbitral tribunal, decisions of international commercial arbitration, decisions of foreign courts and other grounds determined by law or an international treaty of Ukraine;

The remuneration of the private executor is collected from the debtor. Additional remuneration to the contractor can be paid by the claimant, if desired, based on the results of the work done.

The need to pay an advance fee may arise only during enforcement, if there is a need to finance specific costs - payment for property valuation services, services of other involved specialists, transportation, storage of property, etc. In this case, the advance payment paid by the recoverer is subject to return at the expense of the debtor.

A private executor is paid a reward for performing enforcement actions.

The remuneration of a private contractor consists of the main and additional.

The main remuneration of a private executor, depending on the enforcement actions to be performed in enforcement proceedings, is established as follows:

  • fixed amount - in the case of execution of a decision of a non-property nature;
  • percent of the amount to be recovered, or the value of the property to be transferred under the executive document.

The amount of the basic remuneration of a private contractor is established by the Cabinet of Ministers of Ukraine. The main remuneration of a private executor, set as a percentage, is charged from the debtor together with the amount to be recovered under the executive document (except for executive documents for the recovery of alimony). The main remuneration, set in the form of a fixed amount, is charged after the full execution of the decision.

An agreement between a private executor and a recoverer may provide for additional advance payment of the costs of enforcement proceedings and additional remuneration for a private executor.

Upon agreement with the recoverer, the additional remuneration of the private executor may be paid during the entire period of enforcement proceedings in whole or in part.

If earlier there was a period for independent execution of the decision - up to 7 days from the date of the decision, then the provisions of the Law of Ukraine "On Enforcement Proceedings" do not provide for such a period. A private executor begins the enforcement of a decision from the moment the enforcement proceedings are opened.

A private executor accepts enforcement documents for execution at the place of residence, location, work of the debtor or at the location of the debtor's property.

The right to choose the place of opening of enforcement proceedings belongs to the recoverer.

    Enforced execution of the specified executive documents includes the use of powers granted by law:

    • entering information about the debtor into the Unified register of debtors;
    • encumbrance of the debtor's property by entering information into the relevant state registers;
    • direct access to information about debtors, their property, income and funds, including confidential information contained in state databases and registers, including electronic ones;
    • receiving from state bodies, enterprises, institutions, organizations, officials, parties and other participants in executive proceedings explanations, certificates and other information, including confidential information, necessary for carrying out executive actions;
    • identification, seizure and debiting of funds from the debtor's accounts;
    • identification, search, seizure and forced realization of the debtor's property;
    • applying to the court to obtain a decision on forced entry into the home or other property of a natural person or other person in which the property of the debtor or property and funds belonging to the debtor from other persons is located and, accordingly, upon receipt of such a decision - unhindered entry to land plots and to premises, inspection, sealing of such premises, seizure, sealing and seizure of the debtor's property located there;
